These Terms & Conditions apply to the website, digital products and related services provided by Healing Mental Health (HMH).

Please read these Terms carefully before using our website or completing a purchase. By placing an order, you agree to the Terms & Conditions applicable at the time of purchase.

Nothing in these Terms is intended to exclude or limit any mandatory consumer rights available to you under applicable law.

2. Scope of these Terms

These Terms apply to purchases made through the Healing Mental Health website and to the use of our digital products, website content and related services.

Additional conditions may apply to specific services, promotions, affiliate programmes or products. Where additional conditions apply, they will be made available before you enter into the relevant agreement.

3. Our products

Healing Mental Health provides digital educational and self-help resources relating to mental health, emotional wellbeing and personal development.

Products may include digital guides, workbooks, worksheets, exercises, downloadable resources and other forms of digital content.

The relevant product page will describe the main characteristics, format, price and contents of the product before purchase.

We aim to present our products as accurately as reasonably possible. Minor differences in colours, formatting or appearance may occur depending on your device, screen, software or PDF reader.

4. Placing an order

Before completing an order, you are responsible for checking that the products selected, contact information, email address and other order details are correct.

An order becomes binding once your payment has been successfully processed and we confirm your order.

We may refuse or cancel an order where reasonably necessary, including where there is suspected fraud, misuse of the website, an obvious technical or pricing error or another legitimate reason that prevents us from fulfilling the order.

If we cancel an order after receiving payment and no valid digital product has been supplied, the relevant amount will be refunded.

5. Age and capacity to purchase

You must have the legal capacity to enter into a purchase agreement.

If you are under 18, a parent or legal guardian must approve the purchase where required by applicable law.

Healing Mental Health resources are not designed to replace professional care for children or adults.

6. Prices and payment

The price payable is the price displayed during checkout when you place your order.

Applicable taxes will be included or displayed where required by law.

Payments are processed using the payment methods available through our online store. These may be provided by Shopify or independent payment service providers.

Payment providers may have their own terms and privacy policies.

Healing Mental Health does not store complete credit or debit card details.

7. Delivery of digital products

Our products are digital and are generally made available electronically after successful payment.

Depending on the product and delivery system, access may be provided through a download link, email, customer account or another electronic method described during purchase.

You are responsible for providing a valid email address and using a device and software capable of opening the file format stated on the product page.

If you do not receive your purchase or experience a problem accessing the file, please contact us at info@healing-mental-health.com.

We will make reasonable efforts to restore access or otherwise resolve legitimate technical problems.

8. Immediate delivery and right of withdrawal

Consumers in the European Union generally have a 14-day right of withdrawal for distance purchases. Special rules apply to digital content supplied immediately.

Before immediate delivery of digital content begins, you will be asked to expressly request immediate delivery and acknowledge that, once delivery or downloading begins, you lose your 14-day right of withdrawal.

Once you have provided that consent and delivery or downloading has begun, you cannot cancel the purchase simply because you changed your mind.

This does not affect your statutory rights where digital content is defective, inaccessible or otherwise does not conform to the contract.

Our separate Refund Policy contains further information about refunds, duplicate purchases and problems with digital products.

EU rules specifically require prior express consent and acknowledgement of the loss of the withdrawal right for immediately supplied digital content.

9. Defective or non-conforming digital content

We are responsible for supplying digital content that conforms to the agreement and applicable consumer law.

If a purchased product is corrupted, inaccessible, materially different from its description or otherwise does not conform to what you were entitled to expect, please contact us.

Where appropriate, we will first attempt to resolve the problem by restoring access, replacing or correcting the file or providing the correct content.

Where a problem cannot be corrected within a reasonable time, or where applicable law otherwise gives you that right, you may be entitled to a proportionate price reduction or termination of the agreement.

EU digital-content rules provide consumers with remedies including bringing the content into conformity, a proportionate price reduction or termination in qualifying circumstances.

10. Personal-use licence

Unless a product page or separate written licence expressly states otherwise, purchasing a Healing Mental Health product gives you a limited, non-exclusive, non-transferable licence to use the product for your own personal purposes.

You are purchasing access to and a licence to use the digital content. You are not purchasing ownership of the copyright or intellectual property rights in that content.

You may download and save your purchased product for your own personal use.

You may not share, distribute, reproduce, upload, publish, resell, sublicense, commercially exploit or otherwise make a purchased Healing Mental Health product available to another person without our prior written permission.

This restriction includes, for example, sending the complete product to another person, uploading it to a shared drive, sharing it in an online group, placing it on a file-sharing website, reselling copies or distributing it through social media, messaging services, forums or similar channels.

Your personal-use licence does not give you permission to remove copyright notices, branding or other ownership information from the product.

11. Unauthorised sharing and contractual penalty

Unauthorised distribution of Healing Mental Health digital products can cause significant harm to our business and intellectual property rights.

If we can reasonably establish that a customer has intentionally or recklessly shared, distributed, uploaded, resold or otherwise made a purchased Healing Mental Health product available to others without permission, we may take reasonable steps to protect our rights.

Where appropriate, we will normally notify you of the suspected violation and provide you with a reasonable opportunity to explain the circumstances and stop the unauthorised distribution.

For a substantiated intentional or reckless violation of this section, Healing Mental Health may claim a contractual penalty of €250 per incident, up to a maximum of €750 per customer, to the extent permitted by applicable law.

A continuous or substantially related course of unauthorised sharing will normally be treated as one incident rather than multiple separate incidents.

We may also require removal of unauthorised copies, revoke or restrict access to the affected digital product and take other proportionate measures reasonably necessary to protect our intellectual property.

Deliberate large-scale or commercial infringement may also result in further legal action where available under applicable law.

Nothing in this section excludes the ability of a court or competent authority to assess the fairness or enforceability of this provision, nor does it limit mandatory consumer rights.

Terms requiring consumers to pay disproportionately high compensation can be considered unfair under EU consumer law, which is why this clause uses a defined cap rather than an unlimited penalty.

12. Intellectual property rights

Unless otherwise stated, all original content made available by Healing Mental Health, including digital guides, workbooks, exercises, written content, graphics, designs, branding, logos and other original materials, is owned by or lawfully licensed to Healing Mental Health.

Such content may be protected by copyright, trademark and other applicable intellectual property laws.

You may not reproduce, distribute, modify, sell or commercially exploit protected content except where expressly permitted by these Terms, applicable law or written permission from Healing Mental Health.

Limited quotations or other uses permitted by mandatory copyright law are not restricted by these Terms.

13. Educational and self-help purpose

Healing Mental Health products and website content are provided for educational, informational and self-help purposes.

They are not medical advice, psychological treatment, psychotherapy, diagnosis or crisis care and are not intended to replace advice or treatment from a qualified healthcare or mental health professional.

Mental health experiences vary significantly between individuals. Information or exercises that are useful to one person may not be appropriate or effective for another.

You are responsible for deciding whether a particular resource or exercise is appropriate for your circumstances and for seeking professional assistance where necessary.

Nothing in Healing Mental Health products should be interpreted as encouraging you to postpone, discontinue or avoid appropriate professional healthcare.

14. Mental health emergencies

Healing Mental Health does not provide emergency or crisis services.

If you believe that you or another person is in immediate danger or is experiencing a serious mental health crisis, do not rely on our website, products, email or customer service for urgent assistance.

Contact the appropriate emergency services, healthcare provider or crisis service available in your location.

15. No guaranteed results

Healing Mental Health does not guarantee any particular medical, psychological, emotional, personal or other outcome from using our products.

Our resources are designed to provide information, reflection and practical tools, but individual responses differ.

Purchasing or completing a product does not guarantee that symptoms will disappear, that a particular technique will work or that a specific personal outcome will occur.

Customer testimonials and experiences reflect individual experiences and do not guarantee that another customer will achieve the same result.

A technique or exercise not working for you personally does not by itself mean the digital product is defective or entitle you to a refund.

Your statutory rights concerning defective or non-conforming digital content remain unaffected.

16. Responsible use of our resources

You are encouraged to use Healing Mental Health resources at a pace appropriate for you.

You are not required to complete every exercise or use every technique contained in a product.

If a particular exercise or resource causes significant concern or appears inappropriate for your circumstances, you should stop using that part of the resource and seek appropriate professional advice where necessary.

17. Limitation of liability

Healing Mental Health remains responsible for its obligations where required by applicable law.

To the fullest extent permitted by law, we are not responsible for indirect or unforeseeable losses arising from use of our products outside their intended purpose or from circumstances outside our reasonable control.

We are not responsible for technical problems caused solely by your device, internet connection, third-party software or other systems outside our reasonable control, although we will make reasonable efforts to assist with genuine access problems.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including any liability or consumer right that cannot legally be excluded or restricted.

18. Customer accounts and security

Where customer accounts are available, you are responsible for keeping your login details secure and confidential.

You must not intentionally provide another person with your account credentials for the purpose of allowing them to access paid products.

We may temporarily suspend or restrict access where reasonably necessary to protect our systems, investigate suspected fraud, respond to a payment dispute or investigate suspected unauthorised distribution.

Such measures will be proportionate to the circumstances and will not restrict mandatory legal rights.

19. Affiliates and referral partners

Healing Mental Health may work with affiliates, creators, influencers or referral partners.

Where a customer purchases through an affiliate link or uses an affiliate or promotional code, the referring partner may receive a commission from Healing Mental Health.

This generally does not change the customer's contractual rights.

Affiliates and partners do not receive ownership of Healing Mental Health content and may only use promotional materials in accordance with the permissions and separate affiliate terms provided to them.

Separate Affiliate Terms may apply to anyone participating in the Healing Mental Health affiliate programme.

20. Discounts and promotional offers

Healing Mental Health may occasionally offer discount codes, launch prices, promotions or other special offers.

Specific conditions may apply to individual promotions and will be communicated alongside the relevant offer.

Unless otherwise stated, discount codes cannot be exchanged for cash and cannot be combined with other discounts.

We may refuse or correct a promotion in cases of fraud, abuse or an obvious technical or pricing error, subject to applicable consumer law and any binding orders already concluded.

21. Reviews and testimonials

Customers may have the opportunity to submit reviews, feedback or testimonials.

Where reviews are displayed publicly, we may moderate content that contains unlawful material, personal information about another person, spam, threats, discriminatory content or content unrelated to the relevant product.

We will not intentionally alter a genuine review in a way that changes the customer's expressed opinion.

Where testimonials are used in marketing, individual experiences should not be interpreted as guaranteed results.

22. Third-party services and links

Our website may rely on or link to services provided by independent third parties, including payment providers, social-media platforms or other websites.

Healing Mental Health does not control independent third-party websites and is not responsible for their content or privacy practices.

Their own terms and privacy policies may apply when you use their services.

This section does not remove any responsibility Healing Mental Health has for services that applicable law requires us to provide.

23. Privacy and personal information

Personal information is processed in accordance with our Privacy Policy.

Our website uses third-party technology providers, including Shopify and payment providers, to operate our online store and process transactions.

Our Privacy Policy explains in more detail what information we collect, why we process it, with whom it may be shared, how long it may be retained and the rights available to you.

24. Complaints and customer support

Please include your name, the email address used for your purchase, your order number where available and a clear description of the issue.

We will make reasonable efforts to investigate and resolve legitimate complaints.

25. Chargebacks and payment disputes

If you believe there is a problem with a payment or purchase, we encourage you to contact us first so that we have an opportunity to investigate the issue.

If a chargeback or payment dispute is opened, access to the relevant digital product may be temporarily suspended while the transaction is being investigated.

We may provide the relevant payment provider with order, payment, delivery, access and communication records necessary to respond to the dispute.

Fraudulent or abusive use of chargebacks may result in restrictions on future purchases.

Nothing in this section limits your right to dispute an unauthorised, incorrect or otherwise legitimately disputed transaction.

26. Events outside our reasonable control

We are not responsible for delays or failures caused by events outside our reasonable control, such as widespread internet or hosting outages, serious failures of external infrastructure, natural disasters or other comparable circumstances.

Where such an event affects delivery of a product, we will make reasonable efforts to restore delivery or provide an appropriate solution.

This provision does not exclude rights or remedies that consumers have under mandatory law.

27. Changes to these Terms

We may update these Terms when reasonably necessary because of changes to our products, services, technology, business practices or applicable law.

The Terms that apply to an individual purchase are generally the version made available when that purchase was concluded, unless applicable law requires otherwise.

Changes will not retrospectively remove rights that you already have under an existing purchase.

The current version will always display the date on which it was last updated.

28. Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

This provision does not allow Healing Mental Health to replace an unfair consumer term with another provision where applicable consumer law does not permit that result.

29. Governing law

These Terms & Conditions are governed by Dutch law.

If you are a consumer who lives outside the Netherlands, this choice of law does not deprive you of mandatory consumer protections that apply to you under laws that cannot legally be excluded.

Disputes may be submitted to a competent court in accordance with applicable law.

30. Availability of these Terms

These Terms will be made available to customers before or during the purchase process in a form that can be accessed and retained.

You are encouraged to save a copy for your records.

For online sales, Dutch consumer guidance states that general terms should be made available before the purchase and in a way customers can read and retain them.
