These Terms & Conditions apply to the website, digital products and services offered by Healing Mental Health (HMH).
By placing an order through our website, you agree to these Terms & Conditions. Please read them carefully before completing a purchase.
Nothing in these Terms & Conditions limits any rights that consumers have under applicable mandatory consumer law.

2. Our products
Healing Mental Health provides digital self-help, educational and informational resources relating to mental health and personal wellbeing.
Products may include digital guides, workbooks, worksheets, exercises and other downloadable or online resources.
The specific content, format, price and features of each product are described on the relevant product page.
We aim to describe our products as accurately as possible. Minor visual differences in colours, formatting or display may occur depending on your device, software or screen settings.
3. Placing an order
By placing an order, you confirm that the information you provide is accurate and that you are legally permitted to enter into the purchase.
An order is completed when your payment has been successfully accepted and you receive confirmation of your purchase.
We reserve the right to refuse or cancel an order where reasonably necessary, for example in cases of suspected fraud, an obvious pricing or technical error or misuse of our website.
If we cancel an order after payment has already been received and no valid product has been supplied, the relevant payment will be refunded.
4. Prices and payment
The applicable price is the price displayed at the time you place your order.
Where required, prices will include or clearly show applicable taxes in accordance with relevant law.
Payments are processed through the payment methods made available through our Shopify store. Payment processing may be provided by third-party payment providers and is subject to their applicable terms and privacy practices.
Healing Mental Health does not store complete credit or debit card details.
5. Delivery of digital products
Our products are digital and are generally made available electronically following successful payment.
Depending on the product, access may be provided through a download link, email, customer account or another digital delivery method described during the purchasing process.
You are responsible for providing a valid email address and ensuring that your device and software can open the file format described on the product page.
If you do not receive your digital product or experience a technical problem accessing it, please contact info@healing-mental-health.com so that we can investigate and restore access where appropriate.
6. Right of withdrawal and refunds
Consumers purchasing online in the European Union generally have a 14-day right of withdrawal. Different rules apply where digital content is supplied immediately.
Before completing a purchase for immediately supplied digital content, you will be asked to expressly request immediate delivery and acknowledge that, once delivery or downloading begins, you lose your 14-day right of withdrawal.
Once you have given that consent and delivery or downloading has begun, you cannot cancel the purchase simply because you changed your mind.
This does not affect your statutory rights where digital content is defective, inaccessible or does not conform to what was agreed.
Our Refund Policy provides further information about refunds, duplicate purchases, technical problems and your right of withdrawal.
For EU digital content, the withdrawal exception depends on the customer expressly agreeing to immediate performance and acknowledging the loss of that right.
7. Problems with digital products
We want the digital products you purchase to work as described.
If a product is corrupted, inaccessible, materially different from its description or otherwise does not meet applicable legal requirements, please contact us.
Where appropriate, we will first attempt to resolve the problem by repairing the issue, restoring access, replacing the file or providing the correct product.
Where the issue cannot be resolved, you may be entitled to another remedy under applicable consumer law, including a price reduction or termination of the contract in circumstances provided by law. EU law provides specific remedies where paid digital content does not conform to the contract.
8. Personal-use licence
Unless a product page or separate written licence states otherwise, purchasing a Healing Mental Health digital product gives you a limited, personal, non-exclusive and non-transferable right to use that product for your own personal purposes.
Purchasing a product does not transfer ownership of the copyright or other intellectual property rights to you.
You may download, save and use the product personally in accordance with these Terms.
You may not reproduce, upload, distribute, share, sell, sublicense, commercially exploit or make the product available to another person without prior written permission from Healing Mental Health.
This includes sharing purchased files through websites, social media, file-sharing services, shared drives, online groups or similar services.
9. Intellectual property
Unless otherwise stated, the content made available by Healing Mental Health, including our digital products, written content, branding, graphics, designs and original materials, is owned by or lawfully licensed to Healing Mental Health and is protected by applicable intellectual property laws.
You may not copy, modify, reproduce, publish, distribute or commercially exploit protected content except where permitted by law or with our written permission.
Nothing in these Terms restricts rights that cannot legally be restricted.
10. Educational and self-help purpose
Healing Mental Health creates resources for informational, educational and self-help purposes.
Our products and website content are not medical advice, psychological treatment, therapy, diagnosis or crisis care and are not intended to replace support from a qualified healthcare or mental health professional.
Mental health experiences differ from person to person. We cannot guarantee that a particular technique, exercise, recommendation or resource will be suitable or effective for every individual.
You remain responsible for deciding whether a resource is appropriate for your circumstances and for seeking professional assistance where necessary.
If you believe that you or another person is in immediate danger or experiencing an urgent mental health crisis, please contact the appropriate emergency or crisis service in your location.
11. No guaranteed results
We do not guarantee a particular emotional, psychological, health, personal or other outcome from using Healing Mental Health products.
Progress and responses to self-help resources differ between individuals. A strategy that is useful to one person may not be useful to another.
Statements, testimonials or customer experiences displayed on our website reflect individual experiences and should not be interpreted as a guarantee that another customer will experience the same result.
12. Responsible use
Our products should be used in accordance with their intended educational and self-help purpose.
You should stop using an exercise or resource if you believe it is inappropriate for you or causes concerning symptoms, and seek appropriate professional advice where necessary.
Nothing on our website should be interpreted as encouraging you to delay or avoid necessary professional care.
13. Limitation of liability
Healing Mental Health is responsible for its obligations to customers in accordance with applicable law.
To the fullest extent permitted by law, we are not responsible for losses that were not reasonably foreseeable or that arise from use of our products outside their intended purpose.
We are also not responsible for problems caused by circumstances outside our reasonable control, such as failures of a customer's device, internet connection or third-party services, although we will make reasonable efforts to assist where appropriate.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law, nor does it restrict mandatory consumer rights.
14. Customer accounts and access
If we offer customer accounts or ongoing digital access, you are responsible for keeping your login credentials secure.
You may not provide another person with account access for the purpose of sharing paid digital products.
We may temporarily restrict or suspend access where reasonably necessary to protect our systems, investigate suspected fraud, respond to a payment dispute or prevent unauthorised distribution.
Any such action will be taken in accordance with applicable law and will not affect rights that cannot legally be excluded.
15. Affiliate links and discount codes
Healing Mental Health may work with affiliates, creators or referral partners.
If you make a purchase through an affiliate link or use an affiliate or promotional code, the referring partner may receive a commission from Healing Mental Health.
Affiliate arrangements do not change the price or contractual rights applicable to your purchase unless a specific promotion expressly states otherwise.
Separate terms may apply to individuals who participate in the Healing Mental Health affiliate programme.
16. Discounts and promotions
From time to time, Healing Mental Health may offer discounts, promotional codes or limited-time offers.
Specific conditions may apply to a promotion and will be communicated with the relevant offer.
Unless otherwise stated, promotional codes cannot be combined and cannot be exchanged for cash.
We may withdraw or correct a promotion where there has been an obvious error, fraud or misuse, subject to applicable consumer law and any orders that have already become binding.

We process personal information in accordance with our Privacy Policy.
Our website relies on third-party providers, including Shopify and payment and technology providers, to operate our store and fulfil certain services.

These Terms & Conditions are governed by Dutch law.
If you are a consumer living in another country, this choice of law does not deprive you of any mandatory consumer protections that apply to you under the laws that cannot legally be excluded.
Where a dispute cannot be resolved directly between us, it may be submitted to a competent court in accordance with applicable law.
